Mumbai: Dr. Yi Ching Ling, who was head of the Unit and Professor of Gynecology and Obstetrics at Nair hospital failed to act on multiple complaints regarding inappropriate behavior, which amounts to intentional omission and abetment, the special SC/ST court has said allowing prosecution’s plea to add her as an accused in the case.

The special court had last month allowed, prosecution’s plea to add Dr Ling as an accused in the case of abatement to suicide of Dr Tadvi. In its detailed order released on Thursday, the special judge SM Tapkire has said that, Ling is also involved along with chargesheeted co-accused, three senior doctors, facing the trial in the case.

The court said that the prosecution and the informant, should be given a chance to substantiate the serious allegations raised against the charge-sheeted accused and proposed accused.

The court went on to say that Ling ‘absolutely did nothing upon raising various complaints with her in regard to objectionable ‘ultra-vires’ conduct of charge-sheeted accused which comes under the purview of intentional omission as the same is also a part of the factum of abetment.’

The special court heavily relied on the report of Anti Ragging Committee. The court said, the Anti-Ragging Committee's report highlights that the victim's mother and husband approached the proposed accused regarding the ragging, harassment, and ill-treatment by the trio accused.

The proposed accused, as the head of the unit, failed to report these activities to her superiors, either orally or in writing. She also did not act on the repeated complaints from the victim's mother about the trio's misconduct. The report clearly states that the proposed accused did not handle these serious complaints with the necessary seriousness or caution, reads the order.

Dr Tadvi, 26, was a second-year student and resident doctor at BYL Nair Hospital. On May 22, she committed suicide. Her family alleged that she was driven to take the step because the three accused, also doctors at BYL Nair Hospital, harassed Dr Tadvi for her tribal identity and being a quota student. Three senior doctors namely - Dr Ankita Khandelwal, Dr Bhakti Mehare and Dr Hema Ahuja, are facing prosecution for abatement to suicide.
