Bhopal (Madhya Pradesh): The District and Sessions Court has awarded Rs 2.93 lakh, along with 9 percent interest, to petitioner Vivek Jain in a cheque bounce case.
The order was passed by JMFC Gunjan Sharma. Vivek Jain, a resident of Amrapali, Lalghati, and Prakash Nagvanshi, from Tilajamalpura, both run shops in Ashima Mall, Misrod Road, and were friends.
According to the case, Vivek Jain sold furniture worth Rs 95,000 to Prakash Nagvanshi but instead of paying the amount, Nagvanshi borrowed an additional Rs 91,000 from Vivek.
Over time, Nagvanshi failed to return either sum. After sending a notice, Nagvanshi signed an agreement on March 20, 2016, and issued a cheque of Rs 1.80 lakh on May 20, 2018.
However, the cheque was dishonoured by the bank. Advocate Abhai Jain, representing the petitioner, told Free Press, "The court has awarded Rs 2.93 lakh to Vivek Jain in the cheque bounce case. The court also sentenced Nagvanshi to one year in prison for non-payment of the amount."
Despite the friendly relationship between the two, Nagvanshi breached the trust by failing to return Rs 1.83 lakh, which led Vivek to file a suit. The accused repeatedly changed his defence, ultimately failing to establish a case before the court.
