The Supreme Court on Monday dismissed the plea filed by deceased Bengaluru techie Atul Subhash' mother seeking the custody of her grandson. A Bench of Justice BV Nagarathna and Justice Satish Chandra Sharma allowed the child to remain with his mother, Nikita Singhania.
Nikita, the estranged wife of Atul Subhass, is facing charges of harassing and abetting him to commit suicide.
Before deciding on custody of the child, the court interacted with the child through video conferencing earlier today.
The child's grandmother, Anju Devi, had moved the Supreme Court alleging that her daughter-in-law was not revealing the whereabouts of the child.
According to reports, during today's hearing, the petitioner sought more time to file a more detailed affidavit, but the court rejected the request saying, "This is a habeas corpus and we want to see the child."
The boy appeared before the court through video conference.
Earlier this month, Nikita Singhania had informed the court that her child was studying at a boarding school in Haryana's Faridabad and he would be taken back to his mother in Bengaluru.
After this, the court asked to present the child before the court for the next hearing.
During the last hearing, the court had remarked that "the child is a stranger to his grandmother," noting the boy had spent barely any time with the petitioner.
Atul's wife Nikita and her mother and brother were arrested by the Bengaluru Police and were later released on bail.
34-year-old Suhas had died by suicide in Bengaluru, leaving behind an 81-minute-long video and an elaborate suicide note blaming his estranged wife Nikita Singhania and her family members for harassing him and filing false cases against him.
